Arcaeon Software License and Intellectual Property Notice

Not legal advice; the terms under which the Arcaeon software is licensed.

Effective date: 24 October 2026

Copyright 2026 Daniel Hill, founder of Arcaeon, doing business as Arcaeon. All rights reserved.

Arcaeon, including the Arcaeon desktop application, the Arcaeon seal, the Arcaeon witness, the Arcaeon record formats and protocols, the documentation, the website, and the Arcaeon name and marks (together, the "Software"), is the exclusive property of Arcaeon and is protected by the copyright laws of the United States and other countries, by international treaties, and by trade secret and trademark law.

  1. License. Arcaeon grants you a limited, revocable, non-exclusive, non-transferable license to install and use the Software, in object code form only, on machines you control, solely for your own use in accordance with these terms and any order or plan you have with us. No other right is granted. Any use of the Software that is not expressly permitted here is prohibited.

  2. Restrictions. Except as expressly permitted in writing by Arcaeon, you may not, and you may not permit, assist, or hire anyone else to: (a) copy the Software, except for one backup copy; (b) distribute, publish, sell, resell, rent, lease, lend, sublicense, host, or otherwise make the Software available to any third party; (c) modify, adapt, translate, or create derivative works of the Software; (d) decompile, disassemble, reverse engineer, or otherwise attempt to derive the source code, record formats, protocols, keys, or algorithms of the Software, except to the extent that applicable law expressly prohibits this restriction; (e) remove, obscure, or alter any copyright, trademark, or other proprietary notice; (f) use the Software, or any output, documentation, or knowledge derived from it, to develop, train, or improve any product or service that competes with the Software; (g) use the Software to violate any law or the rights of any person; or (h) access the Software in order to build a product or service that imitates its ideas, features, functions, or graphics.

  3. Ownership. The Software is licensed, not sold. Arcaeon and its licensors retain all right, title, and interest in and to the Software, including all intellectual property rights, and all copies, modifications, and derivative works, by whomever made. Your records are yours; the Software that keeps them is ours.

  4. Open components. Where the Software includes components released under an open source license, that license governs those components to the extent it conflicts with these terms. The list of such components and their licenses ships with the Software.

  5. Enforcement. Any unauthorized copying, distribution, modification, reverse engineering, or competitive use of the Software is a breach of these terms and an infringement of Arcaeon's rights, and may also violate the Digital Millennium Copyright Act, the Defend Trade Secrets Act, the Computer Fraud and Abuse Act, and state law. You acknowledge that such a breach would cause Arcaeon harm that cannot be adequately compensated by money, and you agree that Arcaeon is entitled to injunctive relief and specific performance, in addition to all other remedies at law or in equity, including actual damages, statutory damages where available, disgorgement of profits, and recovery of its costs and reasonable attorneys' fees. Arcaeon reserves every right not expressly granted here and will enforce its rights to the fullest extent of the law.

  6. Term and termination. This license is effective until terminated. It terminates automatically, without notice, if you breach any term. On termination you will stop using the Software and destroy all copies. Sections 2, 3, 5, 7, 8 and 9 survive termination.

  7. No warranty. THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. A SEALED RECORD PROVES THAT THE RECORD HAS NOT CHANGED SINCE IT WAS WRITTEN; IT DOES NOT PROVE THAT WHAT WAS WRITTEN IS TRUE.

  8. Limitation of liability. TO THE FULLEST EXTENT PERMITTED BY LAW, ARCAEON WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR BUSINESS, ARISING OUT OF OR RELATED TO THE SOFTWARE, HOWEVER CAUSED, AND ARCAEON'S TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE IN THE TWELVE MONTHS BEFORE THE CLAIM.

  9. Governing law and venue. These terms are governed by the laws of the State of California and the United States, without regard to conflict of law rules. Any dispute arising out of or relating to the Software will be brought exclusively in the state or federal courts located in San Bernardino County, California, and you consent to their jurisdiction. Arcaeon may seek injunctive relief in any court of competent jurisdiction.

  10. Notices and contact. Notices to Arcaeon: legal@arcaeon.io. Copyright complaints under the DMCA: the same address, marked DMCA. These terms may be updated; the version on arcaeon.io/license on the date you use the Software applies.

  11. Trademarks. ARCAEON is a trademark of Daniel Hill, doing business as Arcaeon. A US trademark application is pending (serial number 50204888). Other names are the property of their owners.
